On August 30, 2021, a federal judge in Arizona vacated the Trump-era Navigable Waters Protection Rule, which provided a narrower definition of waters of the U.S., including wetlands (WOUS). The U.S. Environmental Protection Agency and the US Army Core of Engineers are currently working to redefine WOUS, and according to the court order the agencies intend to restore the pre-2015 regulatory definition of WOUS.

Although the agencies have not provided a timeline for a new regulatory definition, Raba Kistner, Inc. is watching this closely, and our environmental experts have navigated WOUS regulatory changes for decades. Contact Brady O'Neal, CPESC, at [email protected] with questions on how this ruling may impact your project and for the most current regulatory updates. #Environmental #WOUS #EPA #USACE #Wetlands
